General Terms and Conditions

1. General

1.1 The client agrees with Hotel Schwarz Alm arte Hotel GmbH, hereinafter referred to as “Hotel Schwarz Alm”, that these general terms and conditions apply exclusively to this and all future bookings. Conflicting contractual or business terms and conditions are excluded.

1.2 The reservation of guest rooms and the agreement of other services and deliveries shall become binding for both parties to the contract upon written confirmation by Hotel Schwarz Alm. Offers are always subject to change.

1.3 In the event of discrepancies between a verbal order and a written order or written order confirmation from Hotel Schwarz Alm, the latter shall prevail.

2. Prices

2.1 The prices quoted are inclusive of taxes and duties.

2.2 Any increase in the VAT rate after conclusion of the contract shall be borne by the customer.

2.3 If the period between conclusion of the contract and provision of the service exceeds 6 months, Hotel Schwarz Alm reserves the right to make price changes.

3. Payment

3.1 Unless otherwise agreed in writing, the customer must pay the contractually agreed remuneration to Hotel Schwarz Alm without any deductions upon receipt of the invoice.

3.2 If the customer defaults on a payment to Hotel Schwarz Alm under this or another contract or if the customer’s poor financial situation becomes known (e.g. bill protests, dishonour of cheques, lawsuits, executions), all claims shall become due and payable; in this case, the customer must pay the entire remuneration for all future services of Hotel Schwarz Alm at least 30 days in advance. If the customer does not fulfil this obligation, Hotel Schwarz Alm is entitled to withdraw from the contract without setting a grace period.

3.3 Payments must be made in cash against receipt or by direct debit and are only deemed to have been made at the time they are credited to Hotel Schwarz Alm’s bank account. Hotel Schwarz Alm is not obliged to accept bills of exchange or cheques; however, should such be accepted, this shall only be on account of payment and subject to encashment. All associated (discount) charges shall be borne by the customer.

3.4 Two or more customers shall be jointly and severally liable for all obligations.

3.5 The customer is not entitled to offset their claims against Hotel Schwarz Alm against their liabilities to Hotel Schwarz Alm.

3.6 In the event of default in payment, the customer shall pay 15% interest on arrears p.a.

4. Cancellation

4.1 Cancellation conditions for private guests

The General Terms and Conditions for the Hotel Industry AGBH 2006 apply.

Take the opportunity to take out travel insurance.

Cancellation free of charge is possible up to 14 days before arrival. The room is non-transferable. After that the following cancellation conditions apply:

13-7 days before arrival: 50% of the travel price
6-3 days before arrival: 75% of the travel price
2-1 day before arrival: 90% of the tour price

In the event of a no-show, cancellation on the day of arrival or early departure, the hotel reserves the right to charge 100% of the travel price.

4.2 Cancellation conditions for seminar and banquet events

In the event of cancellation within 6 weeks before the date of the event, 50% of the booked turnover will be charged and within 3 weeks 100% of the booked turnover will be charged.

A 5% deviation in the number of persons will not be charged.

In the case of a booking that takes up more than 70% of the total room capacity of the hotel, the cancellation period changes as follows:

In the event of cancellation

within 8 weeks before the date of the event 50% and
within 4 weeks 100% will be charged

of the booked turnover will be charged.

A 5% deviation in the number of persons will not be charged.

4.3 Any costs incurred by the Hotel Schwarz Alm in the preparation of a confirmed group programme, in particular the hiring of music groups, tours or similar or any resulting cancellation costs, shall be borne by the client.

5. Notification, place of jurisdiction

5.1 The client must notify Hotel Schwarz Alm by registered letter of any change of address before fulfilling his obligation.

If this is not done, declarations and notifications by Hotel Schwarz Alm to the last known address of the customer shall be effective.

5.2 The place of jurisdiction is Zwettl. Austrian law shall apply as agreed.
